Modernization Surcharge: Basics

Short: The modernization surcharge allows landlords to pass on part of the cost of value-increasing construction measures to the rent. Unlike maintenance, this involves improvements that go beyond simply preserving the apartment.

In more detail: In Germany, legal caps are prescribed to prevent modernizations from leading to disproportionate rent increases.

In detail

  • Distinction from maintenance: Repairs that merely restore the original condition may not be billed via the modernization surcharge.
  • Typical measures: Thermal insulation, new windows, installing an elevator, or bathroom renovation are often considered eligible modernizations.
  • Notification requirement: The landlord must announce planned modernizations in writing in good time and communicate the type, scope, and expected rent increase.
  • Rent increase cap: The annual rent increase from modernization is legally capped at a certain percentage of the previous rent.
  • Hardship clause: Tenants can object under certain circumstances if the modernization would mean an unreasonable financial hardship.
  • Energy renovation as a special case: Measures for energy savings are often separately subsidized and are sometimes subject to different regulations.
  • Checking the calculation: Tenants should carefully check the cost breakdown, since only a certain percentage of actual modernization costs may be passed on (mietspiegel-und-mietpreisbremse, schoenheitsreparaturen).
