Termination for personal use

In short: A landlord may terminate a tenancy if they need the flat for themselves, relatives or household members. They must give a concrete reason.

In more detail: The law requires a legitimate interest. A pretext can lead to damages.

In detail

  • Form: Termination must be in writing and state the reasons.
  • Periods: The longer the tenancy, the longer the notice period (three, six or nine months, kuendigungsfristen-im-mietverhaeltnis).
  • Hardship: Tenants can object, for example in very old age, severe illness or if no replacement housing can be found.
  • Blocking period: For converted owner-occupied flats a termination blocking period applies.
  • Help: Get advice early from a tenants’ association or lawyer. Do not move out without checking.
